By accessing or using the Stagrr website and AI home staging service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
Stagrr provides AI-powered virtual home staging. You upload photographs of rooms, select a design style, and our Service generates digitally staged versions of those rooms using third-party artificial intelligence models. The Service is intended for visualization purposes only.
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activities that occur under it. You must be at least 18 years old to use the Service.
Staging is priced per batch of images as displayed at the time of purchase. All payments are processed securely through Stripe. Prices are in USD and are subject to change. All sales are final — due to the nature of AI-generated content, we do not offer refunds once images have been generated. If generation fails due to a technical error on our end, we will re-process at no additional charge or issue a refund at our discretion.
Your Ownership: You retain all rights to the photographs you upload.
License to Us: By uploading images, you grant us a limited, non-exclusive license to process, transform, and store your images solely for the purpose of providing the Service. We do not claim ownership of your uploads.
Your Representations:You represent and warrant that you have the right to upload the images you provide, that the images do not infringe on any third party's rights, and that the images do not contain illegal, obscene, or harmful content.
Prohibited Content: You may not upload images that contain personally identifiable information of others without their consent, copyrighted material you do not have rights to, or any content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
Nature of Output: Staged images are generated by third-party AI models and are approximations. They are not photographs and should not be represented as actual photographs of the property. Results may vary and are not guaranteed to be architecturally accurate.
No Guarantees: We do not guarantee that AI-generated images will be free from artifacts, errors, or inaccuracies. The AI may alter, add, or remove elements in ways that do not reflect the actual property. Generated images are for visualization and marketing purposes only.
Your Responsibility: You are solely responsible for how you use generated images. If you use them in real estate listings, marketing materials, or any public context, you should clearly disclose that the images are virtually staged and not actual photographs. Misrepresenting AI-staged images as real photographs may violate real estate regulations in your jurisdiction.
Output License: Subject to these Terms and payment, you receive a non-exclusive, worldwide license to use the generated images for personal and commercial purposes, including real estate listings.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT RESULTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STAGRR, ITS OWNERS, OPERATORS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Stagrr and its owners, operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your uploaded content; (c) your use or misuse of generated images; (d) your violation of these Terms; or (e) your violation of any third party's rights.
The Service, including its design, branding, code, and documentation, is owned by Stagrr and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will survive.
These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stagrr regarding the Service and supersede all prior agreements and understandings.
